The learned Advocate for the Applicant has taken us to the order dated 9th March, 2022 that was passed by this Court in Criminal Application No. 802 of 2021, vide which, it was ordered that the Trial Court will not frame any charge in the event the charge-sheet is filed.

The said matter came up before this Court on 2nd August, 2023, when this Court observed in paragraph No.2, that it was not inclined to show indulgence in this matter. In paragraph No.4, it was recorded that if the Forensic Science Laboratory report is adverse to the Accused, liberty was granted to the State to file a supplementary Diksha Rane

26 APL 757-2024.odt charge-sheet. If the Applicant is charge sheeted, it was open to him to approach the Court. It is then recorded in paragraph No.6 that till the report from the Forensic Science Laboratory is received, the charge against the Applicant shall not be framed. The Application was disposed off.

The learned APP submits that the report of the Forensic Science Laboratory has been received.

At the request of the Applicant, stand over to 3rd February, 2025.

We make it clear that we have not granted any interim relief in favour of the Applicant.
