1) We have heard learned Advocate for Applicant at length and also perused the entire record of investigation.

2) After we expressed our opinion that, there is a strong prima facie case exists against the Applicant, learned Advocate for Applicant insisted this Court to further hear him. We accordingly heard learned Advocate for Applicant.

3) When we started dictating the Judgment, learned Advocate for Applicant submitted that, he has instructions to withdraw the Application without inviting an Order on merits.

4) As the learned Advocate for Applicant called upon this Court to spend its precious time, we expressed our displeasure over the conduct of the Applicant.

Osk 28-Apl-901-2024.doc 5) Learned Advocate for Applicant therefore submitted that, for wasting precious time of this Court and allowing the Applicant to withdraw Application with liberty to file an Application for discharge before the trial Court, the Applicant will pay a cost of Rs.10,000/- to the Bar Council of Maharashtra and Goa's Advocate Academy and Research Center, within a period of two weeks from the date of uploading of the present Order on the official website of the High Court of Bombay. The said statement is accepted as an undertaking given to this Court.
