1) Learned Advocate for the Applicant, on instructions, submitted that the Applicant is ready to deposit the balance amount of Rs.18,00,000/- towards compliance of the impugned order. Further, the Applicant is also ready to deposit the additional amount of Rs.2,50,000/- as interest towards delay in depositing entire amount of Rs.28,00,000/- as directed in the impugned order. Further, learned Advocate for the Applicant undertakes to deposit the demand draft for Rs.18,00,000/- with the registry of the Sessions Court, Greater Mumbai within one week and seeks two weeks time to deposit the said additional amount of Rs.2,50,000/-, as interest.
2/2 H.C. SHIV 7.apl942.24.doc Learned Advocate for the Applicant made a statement that, on deposit of the said amount, he has no objection if the Respondent No.2, withdraw the said amounts.
2) Respondent No.2 has no objection to accept the aforesaid submission and statement and to stay the conviction warrant issued against the Applicant, till the next date. Hence, the submission and statement made by learned Advocate for the Applicant is accepted. 3) In view thereof, there shall be ad-interim relief in terms of prayer clause (b) i.e. conviction warrant issued by learned Metropolitan Magistrate, 33rd Court, Ballard Estate in Case No.7667/SS/2018 pursuant to order dated 13/12/2022 passed by learned Additional Sessions Judge in Criminal Appeal No.555/2022, be suspended till the next date.
4) Stand over to 4th September, 2024.
