Learned counsel for the Applicant submits that the aforesaid Application is filed under a bonafide belief that the subject Order can be challenged only by way of present Application. Further, on instructions he seeks leave to withdraw the aforesaid Application with liberty to file Revision against the said Order, in the Sessions Court. 2) Leave to withdraw with the aforesaid liberty. 3) If the Criminal Revision is filed against the impugned Order in the Sessions Court, the said Court shall consider the question of limitation, accordingly.
