By this Application, the Applicant seeks quashing and setting aside of the FIR, registered vide C.R. No.575 of 2024 with the Indapur Police Station, Pune for the alleged offences punishable under Sections 143, 147, 149, 326, 324 etc. of IPC. 2.

Learned APP on instructions states that during the pendency of the aforesaid Application, the Police have filed chargesheet only as against the Applicant Nos.1 and 2. Learned APP further states that as far as Applicant Nos.3 and 4 are concerned, the Police have not filed chargesheet qua them. 3.

In view of the aforesaid statement made by the learned APP, learned counsel for the Applicant seeks leave to withdraw the Application with liberty to pursue the remedy before the Trial Court i.e. of filing a discharge application on behalf of Applicant Nos.1 and 2.

We make it clear that we have not gone into the merits of the FIR/chargesheet and as such keep all contentions of all parties on merits open.

The present Application is accordingly disposed of as withdrawn with liberty as sought.
