The learned APP points out that the Applicant had approached this Court in Criminal Writ Petition No.1941 of 2024, praying for quashing of the First Information Report ('FIR') No.0911 of 2023, registered on 11th September, 2023 with the Sakinaka Police Station, Brihan Mumbai City.

By an order of this Court dated 29th July, 2024, the statement of the learned Advocate for the Petitioner, made on instructions, that the Petitioner desires to withdraw the Petition unconditionally, has been recorded. The order reads as under :- SUNNY THOTE

1.1) Leave granted.

2) Disposed off as withdrawn."

It is conceded that in the present Application, the Applicant is seeking the same relief of quashing of the FIR No.0911 of 2023.

In view of the above, the learned APP is right in contending that this Application is not tenable. 5.

We would have been justified in imposing cost on the Applicant, but for the fact that the learned Advocate has disclosed the fact of filing Criminal Writ Petition No.1941 of 2024, in Paragraph No.12.

In the light of the above facts, this Criminal Application is rejected.
