CORAM :

RAVINDRA V. GHUGE AND RAJESH S. PATIL, JJ.

DATE :

21st January, 2025 P.C. :

1.

A marital discord led the Complainant to file an FIR No. 0888, dated 17th August, 2024 with the Kolsewadi Police Station, Thane City. Sections 373, 34, 498A, 504 and 506 of the Indian Penal Code have been invoked.

2.

The learned A.P.P. submits that after the dispute emerged amongst the Complainant and the in-laws/husband, the preliminary 1/3

inquiry indicates that the parties were on the verge of settlement in the light of her statement made before the Police Officer on 2nd January, 2024. However, thereafter the FIR was registered on 17th August, 2024. 3.

The learned A.P.P. states that the charge-sheet has already been filed.

4.

Considering the peculiar situation as noted above, issue notice to the Respondents, returnable on 3rd March, 2025. The learned A.P.P. waives service of notice on behalf of Respondent No.1. 5.

Copy of the Application paper-book for serving the Complainant, shall be tendered on or before 30th January, 2025, failing which, this Application would be dismissed without further reference to the Court 31st January, 2025.

6.

Office objections, if any, to be removed on or before 6th February, 2025, failing which, the Criminal Application would stand dismissed without reference to the Court, on 7th February, 2025. 7.

Since the charge-sheet has been filed and as the parties were 2/3

on the verge of settling the issue, we direct the learned Trial Court not to frame the charge until the returnable date in this matter. (RAJESH S. PATIL, J.) (RAVINDRA V. GHUGE, J.) 3/3
