IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO. 1799 OF 2024 Ramchandra Badrilal Vishwakarma ...Applicant Vs.

The State of Maharashtra

...Respondent

***** Adv. Tajammul Khan Advocate for the Applicant Shri N. B. Patil APP for the Respondent-State Mangesh Majgar Police Inspector, Cyber Police Station West Region, Mumbai ***** CORAM :

S. M. MODAK, J.

DATE :

29th JULY 2025 P. C. :- 1.

Heard learned Advocate for the Applicant and learned APP. 2.

There are two offences registered against this Applicant. One is CR No. 14 of 2024 registered with the Central Region, Cyber Police Station, Mumbai and another is C. R. No. 39 of 2024 registered with the Cyber Cell, West Region, Mumbai. It is a matter of record that this Applicant was granted bail by the Court of the Additional Sessions Judge, Greater Mumbai, as per order dated 19.06.2024. The Applicant by SEEMA KSHITIJ YELKAR Date:

2025.08.02 12:01:30 +0530 SEEMA KSHITIJ YELKAR 1/3

was directed to furnish bail of Rs. 30,000/-. On depositing the cash amount by way of provisional arrangement, time was granted. 3.

The Applicant deposited Rs. 30,000/-. The receipt is there on page no. 23. He was released from jail. However, he could not furnish the surety within prescribed period/extended period. He applied for extension. However, it was rejected by the Court of the Additional Sessions Judge as per order dated 16.11.2024. 4.

There is some issue about earlier rejection of the extension. Such reference is there in the first para on page no. 20 and a similar reference is there in the order dated 10.10.2024, on page no. 18. When I inquired to the learned Advocate whether now his client is ready to furnish surety, he submitted on instructions that the surety is available and he can furnish it within two weeks. So, instead of going in all this controversy whether his earlier extension was refused or not, or whether it was refused for justifiable reason, this Court feels that the issue can be put to an end by permitting the Applicant to furnish the surety within two weeks.

5.

Hence, the following order is passed:- 2/3

ORDER

(i) The Applicant is granted two weeks time to furnish surety as per order dated 19.06.2024 before the Court of the JMFC, at Bandra from the date of uploading of the order.

6.

With these observations, the Application is disposed of. [S. M. MODAK, J.] 3/3
