This matter was heard for quite some time on 10th January, 2025.

We noticed that the husband and wife were highly educated, both are employed on good positions, both are in their thirties and mature enough to take a decision, that we took the initiative to bring both of them together with the hope that the marriage could be saved. We are aware that there are certain allegations in the First Information Report which cannot be brushed

Trupti 1-APL-1871-2024.odt aside in an Application under Section 482 of the Code of Criminal Procedure, 1973, keeping in view the recent judgments of the Hon'ble Supreme Court in Naresh Aneja alias Naresh Kumar Aneja Versus State of Uttar Pradesh and Another1 and Kaptan Singh Versus State of Uttar Pradesh and Others.2 3.

Granting time till today to take a decision, has not convinced the parties. We would not advert to as to who is not inclined to save the marriage since that is not an issue addressed to the Court.

The learned Advocate for the Applicants submits, on instructions, that the Applicants desire to withdraw this Application. As such, this Criminal Application is disposed off as withdrawn, on instructions.

After the filing of the charge-sheet, if the Applicants desire to avail of a remedy, as is permissible in law, the withdrawal of this Application would not be an impediment and all contentions are kept open.
