This matter was heard for some time. We permitted the learned Advocate for the Applicant to take instructions. 2.

On instructions from the Applicant, who is present in Court, the learned Advocate submits that the Applicant would desire to withdraw this Criminal Application since he desires to take recourse to a remedy of discharge, as is permissible in law, after the filing of the charge-sheet. The learned Advocate for the Applicant prays that all contentions be kept open.

In view of the above, this Criminal Application is disposed off as withdrawn, on instructions.

In the event the Applicant avails of a remedy, as may be permissible in law, for seeking discharge after submission of the charge-sheet, all contentions are kept open and the withdrawal of this Criminal Application would not be an impediment.
