Heard Ms. Hatle, learned Advocate for Applicant and Ms. Newton, learned APP for Respondent - State.

Ms. Hatle would submit that indictment of the Applicant in the present case is under Sections 363 and 370(4) read with 34 of the Indian Penal Code.

Ms. Hatle would submit that 6 out of 7 accused have been enlarged on bail. Accused No.1 who is the present Applicant is akin to the role of Accused No.2. She would fairly submit that Applicant is captured in the CCTV footage and seek holding her baby who is kidnapped. She would submit that Applicant is incarcerated for the past 4 years and charge is also not framed and hence she would

42.BA.9.24.doc persuade the Court to consider his long incarceration coupled with his age of 20 years at the time of incarceration as also the fact that his parents are old and they are vegetable sellers and he has two sisters. She would therefore persuade the Court to consider the Application for bail.

Considering the above, learned Prosecutor shall take appropriate instructions from the Investigating Officer and apprise the Court on the next adjourned date when this Court shall hear the Application in view of the long incarceration of the Applicant. 6.
