By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.106 of 2022, registered with Khadki Police Station, Pune for the offences punishable under Sections 302 of the Indian Penal Code and and Section 37(1) r/w 135 of the Maharashtra Police Act. 3.

In the present matter the applicant allegedly committed murder of his father-in-law and surrendered himself to the police. There are eyewitness and also recovery of knife from the applicant. The offence is very serious.

Thus, there is sufficient incriminating material available on record to show the implicity of the applicant in the alleged offence. As far as trial is concerned, the charge is framed and there is a possibility that the trial will be concluded in near future. 5.

In the circumstance, considering the nature of allegations and the evidence collected by the IO, during the investigation, I am of the opinion that this is not a fit case for grant of bail. 6.

Moreover, after the withdrawal of the first application no change in circumstances are pointed out to maintain the present successive application. Accordingly, the application is rejected. (ANIL S. KILOR, J) varsha
