Heard Mr. Singh, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent.

Applicant in the present case is incarcerated in prison since 02.10.2018 for offences punishable under Section 302 of the Indian Penal Code, 1860 pending trial.

Mr. Singh would inform the Court that 13 out of the probable 34 witnesses have been examined by the prosecution till date and probability of the trial being completed in the foreseeable future is uncertain and hence he would persuade the Court to consider the case of Applicant for grant of bail on the ground of long incarceration. 4.

That apart, on merits of the matter he would submit that three Accused persons have been indicted in the crime for having assaulted the victim with a paver-block. He would submit that the

904.BA.68.2024.doc deceased victim and all Accused persons were all friends and there was some dispute between them which boiled down to the skirmish and scuffle which took place on the date of incident. 5.
