Heard Mr. Nitin Sejpal, learned Counsel appearing for the Applicant and Ms. Veera Shinde, learned APP appearing for the Respondent-State.

In these Bail Applications, by prayer clause (a), the Applicants are seeking quashing of common order of the learned Trial Court passed below Exhibits-143 and 149 in Sessions Case No.397 of 2019. 1/3
The said Applications at Exhibits-143 and 149 were moved by the prosecution on the ground that temporary bail granted on medical grounds to the Applicant-Dilip Dnyaneshwar Pawar on 24th December 2020 and to the Applicant-Dipali Dilip Pawar on 22nd October 2019 be cancelled. Learned Additional Sessions Judge, Panvel, District Raigad by said Order dated 21st December 2023 directed the Applicants to surrender before the learned Trial Court on 10th January 2024.

Mr. Sejpal, learned Counsel appearing for the Applicants states that today in the morning, the Applicants have surrendered before the learned Trial Court and they have been taken into custody. Ms. Shinde, learned APP confirms the same.

It is the contention of Mr. Sejpal, learned Counsel appearing for the Applicants that in view of these developments, prayer clauses (a), (b) and (c) of the Bail Applications do not survive. He states that prayer clause (d) is for a regular bail.

Learned Single Judge (Coram: Nitin W. Sambre, J.) by Order dated 22nd February 2019 rejected the first Bail Application. This is a second Bail Application of the Applicants. However, as Justice Nitin W. Sambre is not available at the Principal Bench of Bombay High 2/3
Court, Stand over to 31st January 2024.

Mr. Sejpal, learned Counsel appearing for the Applicants states that ground for these second Bail Applications is that the trial has not yet commenced.
