14-BA-2287-2022+.doc out to the order dated 21st April 2023, passed by this Court in Criminal Bail Application No. 1454 of 2022, which reads as follows :- ".

This is an Application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail. 2.

Considering the fact that the Applicants are in jail for about 2 years, the Trial Court shall endeavour to conclude the trial as early as possible. If the trial is not concluded within a period of 9 months from the date of receipt of copy of this order, the Applicants are at liberty to file a fresh Bail Application. The Application is disposed of in aforesaid terms."

Ms. Anjali Patil, learned Advocate submits that despite the order dated 21st April 2023 passed by this Court, there has been no progress in the trial. She submits that the charge is not framed yet. She submits that for the delay in trial, the Applicants, who are in custody since 15th September 2021, are suffering. 4.

Ms. Madhavi Mhatre, learned A.P.P. for the State/Respondent states that the Investigating Officer in the matter is not present in the Court today, as he is transferred. She therefore prays for time till Wednesday to take instructions in respect of status of the trial pursuant to the order dated 21st April 2023.
