The first application for bail was rejected on 3/3/2022. Thereafter, second application for bail was filed which came to be withdrawn by the order dated 4/9/2023. Liberty was granted to file a fresh application after six months, if the trial does not progress substantially.

I am informed that even the charge is not framed. The applicant was arrested on 7/5/2021. I propose to keep the present application pending considering that this is the third bail application. There is no progress in the trial even after the second bail application was allowed to be withdrawn. 1/2

BA 187-24.doc However, considering the nature of the accusations, I find it appropriate to request the trial Court to record the statement of the victim in terms of Section 35 of the Protection of Children from Sexual Offences Act, 2012 within a period of eight weeks from the date of production of the copy of this order.
