After arguing the matter for more than 35 minutes on 09.05.2024, Mr. Upadhyay, learned Advocate for Applicant had requested the Court to adjourn the matter on health grounds, hence the matter was fixed today immediately after reopening. Today when the matter is called out, Mr. Upadhyay is not present. Hence the matter is kept back until 4:30 p.m.

Mr. Upadhyay has appeared at 03.50 p.m. and informs the Court that according to the current roster the Criminal Bail Application shall now have to be heard by the Regular Court hearing Bail Application (Coram : Mr. Manish Pitale, J.). Considering that this Bail Application was specially assigned to this Bench by an order of the Hon'ble the Chief Justice of this Court and Application made today by Mr. Upadhyay, Registry shall examine the above issue and confirm the

11. CRI BA-198-2024.docx appropriate Bench as Mr. Upadhyay would suggest that this Bench may not have the roster and jurisdiction to hear the Bail Application. 3.

Mr. Upadhyay also informs the Court that this very matter is also listed on the daily Board at Serial No.45 before the Regular Bench (Coram : Manish Pitale, J.) today.

In view of the above, Registry shall prepare appropriate report to allay the apprehension of the Advocate for the Applicant. Registry is directed to file appropriate report and inform the Court immediately. Registry shall opine appropriately and inform the Court by way of report so that Applicant's apprehension is also put to rest. In the meanwhile, list the Bail Application on 20th June, 2024. To be listed under the caption 'for Directions'.
