Applicant is in prison since date of arrest on 14.01.2021 in an offence punishable under Section 302 of the Indian Penal Code, 1860 (for short 'IPC').

An Advocate has been appointed through the legal aid to represent and espouse cause of Applicant last year. 5.

It is seen that even after the date of appointment matter had appeared on board and was called out on 30.04.2024 when the appointed Advocate was not present. Thereafter matter has been listed on board on various dates over the last one year but it has not reached hearing on any date.

Today when the matter has reached hearing, once again appointed Advocate is not present. Appointed Advocate is directed to remain present on the next adjourned date.

It is clarified that if the appointed Advocate does not remain present on the next adjourned date, Court shall cancel his appointment and shall appoint a new Advocate to represent and espouse cause of the Applicant who has filed the present Application through jail. 8.
