Learned advocate for respondent No.2 submits that this appeal is not maintainable, inasmuch as the offences in this case are under the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and also under the provisions of the Protection of Children form Sexual Offences Act, 2012. In order to buttress his submission, he has relied upon the decisions in the cases of Aniket S/o. Shahadev Labade Vs. State of Maharashtra & Anr. [2023 (6) Mh.L.J. (Cri.) (F.B.) 516 and Renoj R.S. Vs. State of Kerala [2022 SCC OnLine Ker 5435.
