In this application, since offences under the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) are registered, as per the direction issued by this Court, Advocate Nasreen S. K. Ayubi was appointed by the High Court Legal Services Committee to represent respondent No.2. Today, when the application is called out for hearing, the said advocate is not present in Court.

Apart from this, the learned counsel for the applicant has specifically submitted that during incarceration, the applicant has suffered paralytic attack, wherein his right hand and leg are affected and it is submitted that this fact may be taken into consideration by this Court, as the applicant has remained incarcerated from 23rd June 2023.

The learned APP submits that he shall take appropriate instructions and submit a report before this Court. 4.

In view of the above, list the application for further consideration on 3rd September 2024, to be included in the supplementary list.

The learned APP shall submit report, as regards the present health status of the applicant.

Advocate Nasreen S. K. Ayubi, appointed to appear on behalf of respondent No.2, is expected to appear before this Court on the next date of hearing.
