1.

Mentioned at the time of rising.

2.

Heard Mr. Takle, learned Advocate for Applicant and Mr. Karmakar, learned APP for State.

3.

Registry shall peruse the order dated 23.08.2023 in previous Bail Application No. 1898 of 2022 filed by the Applicant before me. Said Bail Application was disposed of as withdrawn after the Advocate for Applicant was heard. Applicant filed fresh Bail Application No. 379/2024 i.e. present Application which is placed before me as per present roster. However there are two previous orders in this Bail Application dated 29.01.2024 and 28.02.2024. From the order dated 28.02.2024 (Coram : Shivkumar Dige, J.), it prima facie appears that there is a reference therein to the previous Bail Application.

11. BA-379-2024.docx 4.

Mr. Takle would inform the Court that present Application has not been heard on merits by any Court though it has been listed before several Courts in the past. Be that as it may, Registry shall consider the aforesaid order in the light of notice dated 04.02.2025 and place the present Bail Application before the appropriate Court. If the present Bail Application is required to be placed before this Court, Registry shall do so after filing an appropriate report to that extent. This exercise shall be carried out by the Registry positively within a period of one week from today.

5.

Mr. Takle is directed to approach the Registry along with a server copy of this order and copies of various orders which are referred to in this order so as to expedite placing of this matter before the appropriate Court. This is in view of the fact that Applicant has been incarcerated for more than 3 & 1/2 years and steps should be taken by Court to list his bail application urgently before the appropriate Court.
