2) By this application under Section 439 of the Code of Criminal Procedure, the applicant is seeking bail in Crime No. 62 of 2023 registered with Indira Nagar Police Station, Dist. Nashik, for the offences punishable under Sections 302, 397 and 394 read with Section 34 of the Indian Penal Code, 1860 and Section 135 of the Maharashtra Police Act, 3) Having gone through the charge-sheet and the material collected by the Investigating Officer during the investigation, it is evident that the offence is very serious and as far as the incriminating material against the applicant is concerned, there is sufficient incriminating material available against the applicant, namely the CCTV footages and 1/2

36-BA-437-24.DOC their identification parade. Furthermore, there is a recovery of knife from the applicant though it was recovered from the open place and other articles having human blood.

4) The CCTV footage at platform No. 1, Nashik Road Railway Station dated 23rd March, 2023, CCTV footage of Mama'j Bar and Restaurant at 19.45 hours in camera No 6, CCTV footage of City Link Bus dated 23rd March, 2023 and CCTV footage at Dadar Sahakari Bhandar dated 19th March, 2023 from where the weapons were purchased, is sufficient to connect the applicant with the alleged offence.

5) Thus, there is sufficient circumstantial evidence available against the applicant to show the involvement of the applicant. In that view of the matter, I am not inclined to grant bail. Accordingly, the application is rejected and disposed of.
