The applicant is arrested on 28/12/2020.

Present application is filed mainly on the ground of delay in trial. In Criminal Application (BA) No.644/2022 liberty was granted to the applicant to file a fresh application for grant of bail, if the trial doesn't commence in next one year. It appears to the Rojnama that trial has already been commenced and the complainant is already examined who has left loyalty towards the prosecution and not supported the prosecution case.

Learned Counsel for the applicant submitted that after evidence of the complainant no other witness is examined.

The applicant is behind bar from last four years. Despite the order passed by this Court why the trial is not commenced, is to be ascertained.

Call the report from the District Judge-3 and Additional Sessions Judge, Akola within a period of one week.

Place the matter after one week.
