Applicant is incarcerated since 24.07.2023 for the offences punishable under Sections 8(c), 22(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 registered with ANC Ghatkopar Unit, Mumbai.

No conscious recovery and possession of the alleged contraband is made from the Applicant who is arraigned as Accused No.2 in the crime Applicant - Accused No.2 was arrested 4 months after the arrest of Accused No.1. He would submit that Accused No.1 was arrested with 110 grams of alleged contraband MD. He in his

68.BA.509.24.doc disclosure statement has disclosed the name of Accused No.2 as supplier. He would fairly inform the Court that Applicant has one antecedent in an offence punishable under the provisions of NDPS Act for which he has been granted bail. Primary vocation of the Applicant is that he is hawker of clothes on the road side. 5.

Learned Advocate for Applicant would submit that solely on the basis of a statement of the co-accused, Applicant is indicted in the present offence and he is incarcerated for the past 1 year, 7 months and 17 days.

Mr. Karmakar, learned APP is directed to take cognizance of the aforesaid submissions made by Mr. Mooman and obtain appropriate instructions about the precise role of the Applicant before me and apprise the Court accordingly on the next adjourned date. 7.

List the Bail Application on Board on 27th March, 2025. To be placed on the 'Supplementary Board'.
