Heard the learned Counsel for the applicant and the learned APP for the State.

The learned Counsel for the applicant, on instructions, seeks leave to withdraw the application.

The learned Counsel for the applicant, however, submits that though this Court by an order dated 31st January, 2024 has requested the learned Special Judge to expeditiously conclude the trial, yet, according to his instructions, trial has yet not commenced.

The learned APP, on instructions, submits that the charge has been framed. However, the witnesses are yet to be examined.

Having regard to the order dated 31st January, 2024 and the fact that the applicant has been in custody for more than three and half years, the learned Special Judge seized with Special Case No.131 of 2021 arising out of CR No.18 of 2021 is requested to make an endeavour to conclude the trial in the Special Case as expeditiously as possible and preferably, within a period of six months from the date of the communication of this order.

In the event the trial is not concluded within the said period, the applicant is at liberty to revive the prayer for bail. 7.
