CORAM : NITIN W. SAMBRE, J DATED : 23rd SEPTEMBER, 2024 P.C:- The applicant is seeking regular bail in Crime No. 275 of 2017 registered with Sarkarwada Police Station, for offences under Sections 307, 302, 141, 147, 148, 149 of Indian Penal Code.

It is not in dispute that the Appeal against the conviction of the co-accused i.e. Harish Rahu Shergir and Lalit Suresh Raut is pending.

The applicant is already charge-sheeted. The charge is framed.

2/2 40 BA 610-24.doc The only reason for not commencing the trial is, the original charge-sheet, being part of the Record and Proceedings in the pending Appeal against conviction of the co-accused. In the aforesaid background, the Bail Application is not pressed. Hence, it stands disposed of as such. Let the record be place before the Registrar, Judicial-1, who shall ensure that the original charge-sheet be made available to the trial court, so that the trial against the applicant can be concluded expeditiously.

That the charge-sheet be made available to the trial court within a period of two weeks from today. In case if the trial is not concluded within a period of six months, liberty to approach before the Court below. (NITIN W. SAMBRE, J.) Tilak
