Heard Ms. Shaikh, learned Advocate for Applicant and Ms. Yadav, learned APP for Respondent.

Ms. Shaikh has persuaded the Court to hear the present Application urgently on the ground of medical condition of Applicant. 3.

The reason stated in the praecipe dated 03.04.2025 is that Applicant has suffered paralytic stroke while in custody resulting in the right side of his face becoming numb and he having suffered a major problem in his right eye requiring a surgery for cyst. 4.

Considering the long incarceration of Applicant pending trial, the present Application shall be heard on merits by the Court as he is incarcerated for more than two years on the next adjourned date. 5.

Ms. Shaikh would persuade the Court to consider the fact

903.BA.668.2024.doc that four Accused persons were apprehended and arrested together with alleged contraband. He would fairly inform the Court that other three co-accused have been enlarged on bail by the Court in view of the non-commercial / intermediate quantity of alleged contraband having been found from their conscious possession. 6.

In so far Applicant is concerned, he was apprehended alongwith 75 grams of alleged contraband namely 'Mephedrone'. 7.

The charge has not been framed as informed by Ms. Shaikh. In that view of the matter, learned APP shall take appropriate instructions and apprise the Court of Applicant's role when this Application shall be heard and decided on the next adjourned date. 8.

Stand over to 15th April, 2025. To be placed on the 'Supplementary Board'.
