CORAM : S.M. MODAK, J DATE : 05 December 2024.
LSP 2 10 aba 68.23.doc P.C. :
In fact, I have heard the elaborate arguments of learned Advocate Mr. Menezes for the applicant and learned APP also. Though learned Advocate for the first informant-Rajendra Dond has argued in anticipatory bail application, I have granted liberty to Mr. Siddhesh Bhole to address the Court for limited time. There was a submission made by learned Advocate Mr. Menezes that his client intends to settle with the first informant-Rajendra Dond and proposal is also communicated to the investigating officer and the first informant. Even Mr. Bhole wants to take instructions from his client, this Court has already made it clear that anticipatory bail application will be decided on merits. But if the parties want to settle, it is their choice and it can be one of the factor for deciding anticipatory bail application.
2.
By way of indulgence, last chance is granted. Matter be listed on 12 December 2024. On that date no adjournment will be granted just because parties want time to take decision on that proposal. On that day Mr. Bhole can address the Court on limited aspect. 3.
Interim order granted earlier to continue till next date. Bail Application No. 691 of 2024 4.
It is true that both the sides have argued this application. As this bail application is arising out of the offence in which the co-
LSP 3 10 aba 68.23.doc accused Sunil is seeking anticipatory bail application, the order in bail application is not passed. For some reason or other hearing of anticipatory bail application is adjourned and kept on 12 December 2024. On 12 December 2024 this Court will pass the order in the bail application.
5.
Stand over to 12 December 2024.
