The application is for grant of bail.

After hearing the learned Counsel for the applicant to some extent and after perusing the observation of this Court while deciding the earlier application of the present applicant in Criminal Application (BA) No.277/2023, I have shown my disinclination to grant bail. Hence, learned Counsel for the applicant seeks permission to withdraw the application with liberty to file after six months if the trial is not commenced.

Considering the brutality and the manner in which deceased was eliminated and considering the pendency before the trial Court such liberty can be granted after one year.

In view of that, the application is disposed of as withdrawn with liberty to file the application after one year, if the trial is not commenced. 5.
