By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.130 of 2023 registered with Igatpuri Police Station, Nashik Rural, for the offences punishable under Sections 306, 498-A. 323 r/w 34 of the Indian Penal Code.

The allegations against the Applicant is that due to his ill treatment the deceased left the house on the date of incident and committed suicide. In the post mortem no injury was found to say that any assault was made. Applicant is the husband of deceased and he is in jail from last more than one year. After completing investigation police filed charge sheet.

Thus, considering the material collected by the Investigating Officer during investigation and the allegations against the
2 of 2 27.BA.746.2024.doc Applicant, though learned APP is opposing the application, I am of the opinion that Applicant is entitled for bail as his further custody is not required.
ORDER
(i) Bail Application is allowed and disposed off; (ii) It is directed that the applicant shall be released on bail in Crime No. 130 of 2023 registered with Igatpuri Police Station, Nashik Rural, for the offences punishable under Sections 306, 498-A. 323 r/w 34 of the Indian Penal Code, on furnishing P.R.Bond of Rupees Twenty Five Thousand with one solvent surety in the like amount;
(iii) The Applicant shall attend Igatpuri Police Station, Nashik Rural, on every 1st and 16th of every month between 10.00 a.m and 11.00 am till conclusion of trial, except on the date of trial; (iv) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence; (v) Liberty is granted to the State for cancellation of bail if the applicant commits similar offence;
(vi) The applicant shall attend the trial before the Trial Court regularly on every date unless exempted by the trial Court for any reason.
