IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION BAIL APPLICATION NO.805 OF 2024 Altaf Aziz Shah ...

Applicant Vs.

State of Maharashtra ...

Respondent Ms. Feroza A. Shaikh for Applicant.

Ms. Megha S. Bajoria, APP for Respondent-State. Mr. Dilip Kamble, PSI, Kherwadi Police Station. CORAM : MANISH PITALE, J.

DATE : DECEMBER 13, 2024 P.C. :

.

During the course of arguments, it was brought to the notice of this Court that the prosecution has already examined 12 witnesses and that it intends to examine only about 5 more witnesses. The learned APP submits that, therefore, the trial can be completed expeditiously. 2.

It is to be noted that the applicant has remained incarcerated from the year 2019, but the trial now appears to be at its final stage. The applicant appears to have criminal antecedents and he has been arraigned as an accused with the gang-leader in a number of FIRs. This is a case where provisions of the Maharashtra Control of Organized Crime Act, 1999, have been invoked.

3.

Considering the stage of the trial, the present application is disposed of with a direction to the concerned Court to complete the trial within six months from today.

4.

If the trial is not completed within the said period of time and the delay is not attributable to the applicant, liberty is reserved to the applicant to renew his prayer for bail.
