This is an Application under Section 439 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking Bail in connection with C.R. No.151 of 2023 registered with Malwani Police Station for offences punishable under Sections 366(A), 370(A), (3), 372, 376 read with Section 34 of Indian Penal Code, 1860 and Sections 4, 5, 7(1)(B) of Immoral Traffic (Prevention) Act, 1956 and Sections 4, 8, 12, 17 and 18 of the Protection of Children from Sexual Offences Act, 2012 (for short 'POCSO').

After I expressed my inclination to reject the Application, learned Advocate for Applicant would persuade me to permit Applicant to withdraw the Application. He would however make a request considering that Applicant is incarcerated for almost two years, trial be expedited.

Learned Trial Court is requested by this Court to expedite the trial according to its convenience.

Mr. Kedia, learned Advocate appears for Respondent No.2. Department shall release the fees of the learned Advocate Mr. Kedia appointed through legal aid to represent and espouse the cause of Respondent No.2 within a period of one week from the date of tabling a server copy of this order in the Department. 6.

Bail Application is dismissed as withdrawn.
