Learned Counsel for the Applicant submits that the Applicant is arrested in November-2019 and since then he is behind the bar. It is his submission that though prior to three months charge has been framed, considering number of witnesses to be examined, it is not possible that trial will get over within few years from now. It is his further submission that there is no allegation against the Applicant of causing actual assault on the deceased however on the basis of Identification 16th March, 2026

14-BA-862-2024.ODT Parade his involvement is sought in the crime. He further argues that there is however no evidence in order to indicate that to on what basis Applicant came to be arrested.

Learned APP opposed the Application by pointing out statement of the injured witness so also eye witness. He however seeks time to respond to the arguments with regard to the material on the basis of which Applicant's involvement was seen in the crime prior to his arrest.
