2) By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.67 of 2022 registered with Gholwad Police Station, Palghar for the offences punishable under Sections 302, 201, 452, 504 and 506 of the Indian Penal Code, 1860.

3) Having gone through the charge-sheet and the relevant material collected by the Investigating Officer during the investigation, it is evident that there is sufficient incriminating material available against the applicant. There was a motive and recovery of axe along with clothes having blood stains.

28-BA-904-24.DOC 4) In the above referred backdrop, the learned Counsel for the applicant submits that there is no evidence to connect the applicant with the alleged offence and since the charge-sheet has been filed, further custody of the applicant is not necessary.

5) Since the offence is very serious and as the sufficient evidence is available on record showing the prima facie involvement of the applicant in the alleged offence, I am of the opinion that this is not a fit case for grant of bail. Accordingly, the application is rejected and disposed of.
