Page 236 Exhibit C is a Birth Certificate issued by the Government of Uttar Pradesh, Department of Medical and Health based on which it is sought to be demonstrated that the applicant-accused was borne in Uttar Pradesh and hence a Indian citizen. It is claimed that in this background, the offence under the Passports Act and Foreigners Act cannot be said to be inferred.

When confronted, the learned APP is handicapped for want of instructions.

In this background, we direct the DCP Crime, Panvel City Police Station to file an affidavit within a period of four weeks dealing with the investigation on the aforesaid documents.
