This is an application for regular bail.

The applicant came to be arrested in Crime No. registered at Nigadi Police Station, Pimpri-Chinchwad for the offences punishable under Sections 302 and 307 read with 34 of the Indian Penal Code and Section 37(1)(3) read with 135 of the Maharashtra Police Act.

It is alleged that on the date of incident which took place on 22.12.2017, the present applicant assaulted the complainant and his friend Dinesh Patil by knife on some minor issue. It is alleged that Dinesh Patil died due to stab injuries inflicted by the present applicant.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

The learned counsel for the applicant submits that the applicant is in jail for more than 7 years. It is submitted that since 14.06.2024 there is no progress in the trial. 6.

On the other hand, learned APP submits that the trial has already commenced. It is submitted that considering the nature of offence, the applicant may not be released on bail. 7.

Though the trial has commenced, however, it is not disputed that there is no progress in the trial since last six months. The applicant is in jail for more than 7 years. In that view of the matter, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] Bail Application is allowed.

B] The applicant be released on bail in C.R. No.722 of 2017 registered at Nigadi Police Station, Pimpri-Chinchwad for the offences punishable under Sections 302 and 307 read with 34 of the Indian Penal Code and Section 37(1)(3) read with 135 of the Maharashtra Police Act on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount. C] The applicant shall attend the concerned police station twice in a month ,i.e., on 1st and 3rd Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial. [N.R.BORKAR, J.] Dinesh S.
