By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.168 of 2023, registered with Panhala Police Station, for the offences punishable under Sections 354, 354(D), 506, 376 of the Indian Penal Code, Sections 4(2), 8, 12 of the Protection of Children from of Sexual Offences Act, 2012 and Sections 3(2)(va), 3(1)(w)(i) (ii) and 3(2)(5) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

The applicant who is married has established physical relations with the victim who is a minor by threatening her. 4.

Having gone through the medical report which supports the case of the prosecution of the penetrative sexual assault by the applicant. Since the offence is serious and considering the age of the victim, who was 15 years old at the relevant time, and the allegations against the applicant along with medical evidence, I am of the opinion that this is not a fit case for grant of bail.
