By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.238 of 2023, registered with Virar Police Station, for the offences punishable under Sections 420, 467, 468, 471 r/w. 34 of the Indian Penal Code and under Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999. 3.
Having gone through the charge-sheet and the material collected by the IO, it is evident that there is sufficient incriminating material against the applicant to show his complicity in the alleged offence. varsha

The learned APP has pointed out there are about 22 gold loans taken by him in the name of various persons. The Whatsapp chat and other material including the statements of witnesses sufficiently show the involvement of the applicant in the alleged offence. The offence is serious and it appears that since inception there was an intention of cheating.

In the circumstances, at this stage, I am not inclined to grant bail to the applicant. Hence, the application is rejected. 6.
Considering the period of incarceration of the applicant, liberty is granted to the applicant to apply afresh after one year, if there is no progress in the trial.
