Applicant is in incarceration since June, 2023. Principal defence taken by the Applicant is that there is complete disregard t the procedure established under Section 52A, where no samples have been drawn at all. That apart he would submit that there is non compliance of the provisions of Section 50 of the NDPS Act. 3.

Learned APP shall take cognizance of the aforesaid submissions and take instructions from the concerned Investigating Officer and apprise the Court on the next adjourned date. 4.
