Heard Mr. Zende, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent No.1 - State. 3.

Today, Ms. Zende, the appointed Advocate to represent and espouse the cause of Applicant has submitted that Applicant has addressed a letter from Jail seeking bail. That letter is dated 23.02.2024. On reading that letter, it is seen that Applicant is the stepfather of the victim. He has no criminal antecedents. Applicant has stated in the said letter that he did not like his wife taking alongwith her the daughter for begging and therefore he scolded both of them. Therefore he has been framed by his wife through the victim. 4.

Be that as it may, considering that this is an indictment

60.BA.1119.24.doc under the Sections of Protection of Children from Sexual Offences Act, 2012 in addition to Sections of Indian Penal Code, 1860, Advocate for Applicant Ms. Zende is permitted to immediately amend the Application and implead victim as party Respondent No.2 to the present Application. Amendment is permitted to be carried out forthwith in the presence of the Court and the same is also endorsed by the Court. Re-verification is dispensed with. 5.

Investigating Officer / Senior Inspector of Police of Malvani Police Station is directed to place the charge-sheet before the Court on the next adjourned date and hand over copy of the same to Ms. Zende, learned Advocate for Applicant. Extra copy for the Court shall be filed in Court on the next date by the learned APP. If Respondent No.2 requires aid and assistance of an Advocate, the same shall be provided by this Court which shall be apprised through the Investigating Officer / APP. Concerned Investigating Officer shall also convey this order to Respondent No.2 through a lady police Officer and file an appropriate report to that effect. Report be placed before this Court on the next adjourned date.
