This is an application for regular bail.

The applicant came to be arrested in Crime No.956 of 2023 registered at Baramati City Police Station, Pune Rural, for the offences punishable under Sections 397, 384, 341, 323, 504, 506, 506(2) of the Indian penal Code, under Sections 4, 25 of the Arms Act and under Section 7 of the Criminal Law Amendment Act.

According to the prosecution, on the date of incident, which took place on 14.11.2023, the present applicant and other co-accused assaulted the father of the complainant as he refused to pay extortion amount to them.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The learned counsel for the applicant submits that the applicant is in jail for one year and four months and the trial has not commenced. It is submitted that there are no other criminal antecedents against the present applicant. 6.
The learned A.P.P. submits that at the time of alleged incident, the present applicant was armed with Koyta. It is thus submitted that considering the nature of offence, the applicant may not be released on bail.

The applicant is in jail for one year and four months and the trial is not likely to be concluded in near future. There are no other criminal antecedents against the applicant. Considering the overall facts and circumstances, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No.956 of 2023 registered at Baramati City Police Station, Pune Rural, for the offences punishable under Sections 397, 384, 341, 323, 504, 506, 506(2) of the Indian penal Code, under Sections 4, 25 of the Arms Act and under Section 7 of the Criminal Law Amendment Act on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount; (iii) The applicant shall attend the concerned Police Station once in a month i.e. on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (iv) Application stands disposed of accordingly.
