Mr. Shaikh, learned Advocate for the Applicant would submit that Applicant is indicted in crime under Sections 397 and 452 read with 34 of the Indian Penal Code, 1860; Sections 3 and 25 of the Indian Arms Act, 1959 and Sections 37(1)(a) and 135 of the Maharashtra Police Act, 1951.

Charge of the prosecution against the Applicant is that he alongwith 3 other accused persons entered into the shop of the First Informant - Complainant and snatched the money, mobile phone, silver idol and silver coin totally worth Rs.17,000/- and left the shop.

42.BA.1159.24.doc Learned Advocate would submit that Applicant is incarcerated since 22.03.2021 for almost 4 years pending trial and all 3 accused persons have been enlarged on bail, out of which one is a juvenile. He would therefore persuade the Court that due to his long incarceration and the nature and gravity of the crime in question, present Application be heard and decided by the Court.

Ms. Bajoria, learned APP appearing in the matter shall take appropriate instructions on the specific role of the Applicant in the present case who is arraigned as Accused No.2 and accordingly apprise the Court when this Application shall be heard and decided by the Court.
