It is brought to the notice of this Court that an earlier bail application filed by this applicant was taken up on merits and thereupon the applicant withdrew the same, as was recorded in the order dated 07.07.2023, passed by this Court (Coram : Smt. Anuja Prabhudessai, J.) in Bail Application No.3978 of 2021.

The said bail application had been filed after the charge-sheet was already on record.

In that sense, the only change in circumstance is that the applicant has undergone further incarceration for a period about 1 year and 2 months.

It is alleged by the learned counsel appearing for the informant that the applicant has filed number of applications and attempted to delay the proceedings before the Trial Court. This is denied by the learned counsel appearing for the applicant.

In this situation, it would be appropriate to call for a report from the concerned Court.

Accordingly, the concerned Court i.e. the District and Sessions Court, Belapur, is directed to submit a report to this Court with regard to the progress in the matter concerning the applicant. Specific details will have to be given in the said report about the number of applications moved by the applicant on various grounds, as also the question as to whether charge has been framed in the matter.

The report be submitted by the aforesaid Court within two weeks from today. The Registrar is directed to forthwith communicate this order to the aforesaid Court.
