The bail is sought on the ground of long incarceration as under trial prisoner. The learned counsel for the applicant submits that the applicant is in jail for five and half years. 2.

The learned A.P.P. for the Respondent-State submits that the trial has commenced and the prosecution has already examined four witnesses. The learned A.P.P. further submits that there are 47 criminal antecedents against the present applicant.

The learned counsel for the applicant submits that only ten cases which are pending and in rest of the cases, the applicant has been acquitted.

Considering the overall facts and circumstances of the case, the prosecution shall endeavour to examine rest of the witnesses within a period of six months from the date of receipt of copy of this order or else this Court will be constrained to release the applicant on bail. 5.

Liberty to renew the request for bail after six months. 6.
