This is an application for regular bail.

The applicant came to be arrested in Crime No.173 of 2021 registered at Jejuri Police Station, District : Pune, for the offences punishable under Sections 302, 307, 120-B, 506 read with Section 34 of the Indian Penal Code, 1860 (for short 'IPC'), Sections 3, 25, 27 of the Arms Act and under Sections 3(1)(i)(ii), 3(2), 3(4) of the Maharashtra Control of Organized Crime Act, 1999 (for short 'MCOC').

According to the prosecution, there was some financial dispute between the present applicant and the deceased. It is alleged that due to said dispute the present applicant, on the date of incident which took place on 16.07.2021, had shot him dead.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The bail is sought on the ground of long incarceration as under trial prisoner. The learned counsel for the applicant submits that the applicant is in jail for three years and ten months and the trial is still at the stage of framing of charge. It is submitted that the deceased was involved in multiple crimes.

On the other hand, the learned A.P.P. for the Respondent-State submits that the case is based on direct evidence. It is submitted that the applicant is a gang leader and involved in three more crimes. It is submitted that considering the nature of offence, the applicant may not be released on bail.

I have perused the statement of the complainant, who is an eye-witness to the incident. According to him, when he told the applicant to stop shooting the deceased, he fired one gun shot at him also. The applicant is involved in three more crimes of serious nature. Considering the overall facts and circumstances, I am not inclined to release the applicant on bail.

The application is rejected.
