The offence is under Sections 354, 354-A, 354-D, 506-II, 376(2)(d)(ii) of the Indian Penal Code, 1860 ("IPC"), under Sections 4, 6, 8 and 12 of the Protection of Children from Sexual Offences Act, 2012 ("POCSO Act") as well as under Sections 67 and 67B of the Information Technology Act, 2000 ("IT Act").

This is a second Application after the withdrawal of the first Application. However, in the meantime, the trial has proceeded and as Satish Sangar 1/2

9-BA-1203-2024.doc per the submission of learned APP, 6 prosecution witnesses have been examined. So, proper course of action will be to wait till the conclusion of the trial. There is no point in hearing this Application because there is much progress in the trial. Let the trial Court complete the trial as early as possible.
