This is an application for regular bail.

The applicant came to be arrested in Crime No.5 of 2023 registered at Anti Terrorism Squad, Kala Chowki Police Station, Mumbai, for the offences punishable under Sections 489A, 489B, 489C, 489D, 201 read with Section 34 of the Indian Penal Code(IPC).

On the date of incident, which took place on

17.07.2022, co-accused Siddesh Patil was apprehended and he was found in possession of certain counterfeit currency notes. During the course of the interrogation the said co-accused Siddesh Patil disclosed the involvement of the applicant. 4.

The bail is sought on the ground of parity. In support of the said ground, the learned counsel for the applicant has placed on record the order passed by the Hon'ble Supreme Court dated 11th February 2025, in SLP (criminal) No.12815 of 2024. By the said order, the Hon'ble Supreme Court has released the co-accused Siddhesh Sanjay Patil on bail. 5.

The learned A.P.P. for the Respondent-State submits that the role attributed to the co-accused Siddesh Patil and the present applicant is not identical. It is submitted that considering the nature of offence, the applicant may not be released on bail.

There are no other criminal antecedents against the present applicant. Considering the fact that the Hon'ble Supreme Court has released co-accused Siddesh Patil on bail and therefore I am inclined to release the applicant on bail.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on bail in connection with Crime No.5 of 2023 registered at Anti Terrorism Squad, Kala Chowki Police Station, Mumbai, for the offences punishable under Sections 489A, 489B, 489C, 489D, 201 read with Section 34 of the IPC on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;

(iii) The applicant shall attend the Kala Chowki Police Station twice in a month i.e. on first and third Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (iv) The applicant shall not commit any other offence; (v) Application stands disposed of accordingly.
