Applicant is incarcerated for 3 years and 9 months for the offences punishable under Sections 395 read with 34 of the Indian Penal Code, 1860. Applicant is arraigned as Accused No.1 and recovery from his is of a knife. There are two other accused also involved in the crime. All three accused are indicted for robbing the Complainant of his gold chain. Gold chain is recovered from the possession of Accused No.3. Both Accused Nos.2 and 3, considering their role in the crime have been enlarged on bail.

Prosecution shall inform the Court about the status of the trial in the present case on the next adjourned date. Considering the long incarceration of the Applicant in the present crime and the submissions made by the learned Advocate that there is discrepancy in respect of the status of the Complainant also, I am inclined to take up this Application for hearing on the next adjourned date.
