By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.2201 of 2020 registered with Warje Malwadi Police Station, Pune District, for the offences punishable under Sections 306, 498-A of the Indian Penal Code.

The allegations against the Applicant is that because of incessant harassment at the hand of Applicant the deceased, the wife of Applicant, committed suicide. Applicant was arrested on 4th November 2022 and for about last four years he is in jail. In the mean time, the charge sheet has been filed.

As far as status of trial is concerned, charge is yet to be framed MANISH SURESHRAO THATTE Date: 2024.07.10 17:01:32 +0530 MANISH SURESHRAO THATTE and there are 21 witnesses. There is no possibility that in near future trial will be concluded.

In the above referred backdrop, having considered and gone through the charge sheet and the material collected by Investigating Officer during investigation, I am of the opinion that no further custody of the Applicant is necessary.

Learned APP strongly opposed the present application on the ground that there is sufficient evidence collected by the Investigating Officer which connects the Applicant with the alleged offence. As far as apprehension expressed by learned APP that if the Applicant is released on bail there is every likelihood that he will not be available for trial as he hails from Uttar Pradesh, the same can be addressed by putting certain stringent conditions.

Accordingly I pass following order :
ORDER
(i) Bail Application is allowed and disposed off; (ii) It is directed that the applicant shall be released on bail in Crime No.2201 of 2020 registered with Warje Malwadi Police Station, Pune District, for the offences punishable under Sections 306, 498-A of the Indian Penal Code on furnishing P.R.Bond of Rupees Twenty Five Thousand with one solvent surety in the like amount;
(iii) The Applicant shall attend Warje Malwadi Police Station, District Pune, on every Saturday between 1.00 p.m to 2.00 p.m till conclusion of trial;
(iv) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence; (v) Liberty is granted to the State for cancellation of bail in case of
3 of 3 80.ba.1315.2024.doc breach of any condition or if the applicant commits similar offence; (vi) The applicant shall attend the trial before the Trial Court regularly on every date unless exempted by the trial Court for any reason.
