Heard Mr. Palande, learned Advocate for Applicant and Ms. Gajare - Dhumal, learned APP for Respondent - State. 3.
Applicant is indicted for the offences punishable under Sections 380, 381, 454, 457 and 120-B read with 34 of the Indian Penal Code, 1860.

Mr. Palande, learned Advocate for Applicant would submit that indictment of Applicant is only on the basis of the allegation that he is seen in the CCTV footage and even that allegation prima facie cannot be proved. He would submit that Applicant has no nexus with the principal Accused who committed the theft in the house, nothing has been recovered from his possession and therefore would urge the Court to consider the Application.

In the present case, Bail Application has been served. 6.
Ms. Gajare - Dhumal, learned APP is directed to take appropriate instructions from the Investigating Officer and apprise the Court about the specific role of Applicant in the crime on the next adjourned date.
